STS approvals for documentation regarding GUP, ZUP, DUP, TDCP, TDDP

The necessary documents for S.T.S. to issue approvals regarding documentation on territorial planning, urbanism and authorizing building/demolishing constructions.

The public administration authorities, economic agents, natural or legal entities may get S.T.S. approvals, according to the following regulations:

  • Law no. 50/1991 on authorizing constructions, republished, with its subsequent amendments;
  • Law no. 350/2001 on territorial planning and urbanism, with its subsequent amendments.

TYPES OF CERTIFIED DOCUMENTATION

Documentation to be certified

Urban planning documentation:
- zone territory planning;
- county territory planning.

Urbanism documentation:
- general urban plan and its own local provisions;
- zone urban plan and its own local provisions;
- detailed urban plan.

Technical documentation to set up new investment locations and to develop the existing ones:
- technical documentation on authorizing construction works;
- technical documentation on authorizing dismantling works.

NECESSARY DOCUMENTS TO OBTAIN S.T.S. LICENCES

A. For Territorial Planning:
- application form submitted to the S.T.S. Director, see attached annex;
- presentation report;
- urban regulation blueprints - functional zoning.

B. For GUP’s:
- application form submitted to the S.T.S. Director, see attached annex;
- presentation report;
- urban regulation blueprints - functional zoning;
- regulation blueprints on technical public utility equipping.

C. For ZUP’s and DUP’s:
-  application form submitted to the S.T.S. Director, see attached annex;
- urban planning certificate;
- for beneficiary/authorized natural entity: ID photocopy;
- for beneficiary/authorized legal entity: photocopied registration certificate;
- opportunity permit;
- legal documents of location (property titles, rental contracts, concession, updated estate chart etc.);
- presentation report;
- extract of local urbanism regulations (only applicable to ZUP);
- development layout plan;
- urban regulation blueprints - functional zoning;
- regulation blueprints on technical public utility equipping.

D. To authorize construction and dismantling works (TDCP and TDDP):
-  application form submitted to the S.T.S. Director, see attached annex;
- urban planning certificate;
- for beneficiary/authorized natural entity: ID photocopy;
- for beneficiary/authorized natural entity: ID photocopy;
- legal documents of location (property titles, rental contracts, concession, updated estate chart etc.);
- technical report;
- development layout plan;
- location plan (scale 1:500 or 1:1000);
- subterranean construction plan, if applicable;
- specialised blueprints: architecture, structure, utilities,facilities and technologic installations;
- survey plan of constructions to be dismantled (only applicable to TDDP);
- other permits obtained from public telecommunication operators.

 
ADDITIONAL INFORMATION
A. The application form to issue approvals can be written and submitted on behalf of beneficiary/facility owner by other legal or natural entities (design institutes, architecture studios, representatives) by means of power of attorney.


B. The items of technical /urban planning documentation are to be submitted in a single copy.

An editable, table-like file will be attached and should contain the following: the geographic coordinates of location as well as the existing and future individual constructions, the absolute elevation relative to Black Sea level of the terrain (these sizes should be expressed in STEREO 70 or WGS 84 systems), as well as the maximum height for each construction;

C. The documentation submitted to the S.T.S. shall be according to the applicable technical regulations and norms, including the appropriate identification elements: official heading (where necessary), authorized signatures, authentic seals, registration numbers etc.;

In the event that S.T.S. imposes construction restrictions, the beneficiary/facility owner shall redo and submit other documentation, in accordance with the conclusions of the analysis performed.

D. S.T.S. can issue, by request,  preliminary approvals to build wind turbine parks and investment objectives located in the safety area of the respective objectives, based on the above-mentioned documentation, except Urban Planning Certificate;

E. In order to prevent negative resolution to submitted documentation, we recommend consulting our institution’s specialists in order to identify the requirements/restrictions regarding authorization and maybe request consultancy during feasibility study (pre-authorization).

F. The S.T.S. approval is issued within 15 weekdays from the registration date of application form to authorize construction works and within 30 weekdays for documentation on urban planning as well as territorial and zonal planning. The duration of correspondence to obtain additional information/data, carry out changes to update documentation will be added to the issue deadline.

G. The submitted data/ information must be accurate, complete and updated, the responsibility of their authenticity belonging entirely to the applicant/owner/beneficiary of the objective.
